NCLAT Halts Insolvency Proceedings Against Reliance Infrastructure After ₹92.68 Crore Payment

New Delhi: Reliance Infrastructure Limited said on Friday that the Appellate Tribunal NCLAT has banned insolvency against the company after a repayment of ₹ 92.68 crore on the tariff as per the energy purchase agreement. In its latest regulatory filing, Reliance Infrastructure said that the National Company Law Appellate Tribunal (NCLAT) has banned an NCLT order on an appeal filed by it.

The Mumbai Bench of the National Company Law Tribunal (NCLT) directed the appointment of an interim resolution professional against the Corporate Insolvency Resolution Process and Reliance Infrastructure on 30 May this year.

The NCLT order came after the IDBI Trusteeship in April 2022, with a petition filed at a default of more than ₹ 88.68 crore till August 28, 2018.
In a regulatory filing on 2 June this year, Reliance Infrastructure stated that the NCLT order “already made on full payment” has deteriorated.

On 4 June, the NCLAT suspended the NCLT order after hearing the company’s appeal, stating that it had paid a full payment of ₹ 92.68 crore to Dhursar Solar Power Private Limited (DSPPL).


Reliance Infra said in its June 2 statement, “The company has paid a full payment of 92.68 crores to Darser Solar Power Private Limited in the direction of tariff’s claim as per the energy purchase agreement with the company.” The IDBI Trusteer, in its petition, accused DSPPL for supply of solar energy for the supply of solar energy by DSPPL for the supply of solar energy by DSPPL on the 10 invoices raised between 2017 and 2018.

Payment was sought by DSPPL’s Security Trustee IDBI Trusteeship.
